Terms of Service

NEXT U is a guided AI ad-creation platform (copy, images, video, music). By creating an account or using the Service, you agree to these Terms.

You are responsible for safeguarding your account credentials and all activities conducted under your account. You must provide accurate and complete information and be of legal age to enter into contracts in your jurisdiction.

The Service operates on prepaid credits (1 credit = USD $0.01, fixed value). Charges apply only at the time of top-up; credits are deducted atomically and only upon successful generation. Credit pricing remains constant. Please refer to the Credit Validity and Refund Policy pages for details.

You agree to use the Service in compliance with applicable laws and regulations, and not to generate, upload, or distribute content that is unlawful, infringing, deceptive, or abusive. Specifically, you must not:

• Infringe intellectual property or personal rights. Upload only material you own or are licensed to use. Do not infringe copyright, trademark, publicity, or privacy rights. Generated output must also comply with the terms of the underlying AI providers, including any commercial-use restrictions.
• Create sexual or non-consensual content. No sexually explicit, pornographic, or otherwise NSFW material. Do not use any real person’s likeness, image, or voice without their consent — including deepfakes, impersonation, or misleading synthetic media.
• Advertise illegal or regulated products. Do not use the Service to create or promote content relating to illegal or regulated goods or services — including drugs or paraphernalia, alcohol, tobacco or vaping products, weapons or ammunition, gambling, pharmaceuticals or supplements, adult content, or any item restricted by applicable law or by our payment partners.
• Abuse the platform. Do not bypass usage limits, rate limits, or security controls, nor interfere with the Service in any way.

You are solely responsible for the content you create and how you use it. We may impose per-account daily limits and may review, suspend, or terminate accounts for abuse, risk, or violation of these Terms.

You retain rights to source material you upload and to assets you generate, subject to the terms of the underlying AI providers. You are responsible for ensuring you have the necessary rights to your uploads and for lawful use of generated output.

The Service is provided “as is”. AI-generated output may be inaccurate, incomplete, or unsuitable. You are responsible for reviewing and validating output before use. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We may update the Service and these Terms from time to time; material changes will be posted here. We reserve the right to suspend or terminate accounts that violate these Terms or pose risk to the Service.

These Terms shall be interpreted in accordance with the applicable laws of the user’s place of residence, and disputes shall be subject to the jurisdiction of the courts located in that jurisdiction. Local consumer-protection laws and mandatory legal rights remain unaffected.

We process personal data in accordance with applicable data-protection laws, including but not limited to the EU General Data Protection Regulation (GDPR), the UK Data Protection Act, and relevant U.S. state laws such as the California Consumer Privacy Act (CCPA).

• Collection and Use: We collect and use only the data necessary to provide and improve the Service.
• Retention: Data is retained only for the period required to achieve the stated purposes.
• User Rights: Depending on your jurisdiction, you may have rights to access, rectify, delete, or restrict the processing of your personal data.
• Cross-Border Transfers: Where data must be transferred across borders, we will implement appropriate safeguards as required by law.

To the maximum extent permitted by applicable law:

• NEXT U shall not be liable for any indirect, incidental, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, business interruption, or reputational harm, arising out of or related to your use of the Service.
• Our total aggregate liability for any claim under these Terms shall not exceed the amount you paid for credits in the twelve (12) months preceding the event giving rise to the claim.
• Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
